Private individuals and public officials will have expanded guarantees under the Improbity Law

Lawyer Isabella Martinho Eid Magdesian, a member of the firm’s Administrative and Regulatory Law team and a Master’s degree holder in Administrative Law from the Pontifical Catholic University of São Paulo (PUC-SP), published an article in Estadão on October 25, 2021, commenting on the main changes brought about by Law 14.230 of October 25, 2021, in relation to Law No. 8.429 of June 1992, which deals with administrative misconduct. The presidential sanction of the new law was published on October 26, 2021. Among the main changes, the following stand out: the provision of a closed list of conducts considered acts of administrative misconduct, the suppression of the negligent form of misconduct, and the exclusive right of the Public Prosecutor’s Office to file the action.
