Supreme Court suspends parts of decree prohibiting the dismissal of unvaccinated individuals

Last Friday, November 12th, Minister Luís Roberto Barroso of the Supreme Federal Court (STF) suspended sections of Ordinance No. 620/21 of the Ministry of Labor and Social Security, which prevented companies from requiring proof of Covid-19 vaccination from employees. The matter will still be brought before the full STF panel, but a date has not yet been set. The decision allows employers to require proof of vaccination and, eventually, dismiss employees if they deem that the employee’s refusal represents a risk to the work environment. In the decision, the Minister makes an exception for people who have a medical contraindication to vaccination.
