The International Trade team provides the following legal services:
Trade Defense
- Representation of Brazilian industries, importers, and exporters in trade defense cases (antidumping, safeguards, and countervailing measures) before Brazilian and foreign authorities;
- Development and execution of strategies with the Brazilian government and others in the context of trade defense measures;
- Analysis and review of documents to be submitted;
- Representation of interested third parties.
Examples of the team’s involvement include procedures involving cutlery, ceramics, shoes, textiles, paper and pulp, steel, chemicals, and others.
Preventive advisory services for international trade and regulatory matters
- Review and suggestion of changes to regulations related to the international trade of goods and services (INMETRO, ANVISA, SISCOSERV and others);
- Assistance to companies facing restrictions on the import or export of goods and services;
- Assistance on customs law issues such as: customs classification, customs valuation, special customs regimes, import licenses and import taxes;Assistance on anti-corruption issues and compliance training.
The team has already worked in defending the interests of Brazilian companies in the toy, chemical and other sectors, on issues related to the Brazilian Nomenclature Detailing (DBN), administrative procedures for changing import rates, assistance with INMETRO, drafting codes of ethics in accordance with anti-corruption legislation and general import and export advice.
Market Access
- Analysis of barriers to international trade and identification of solutions to avoid risks and improve results;
- Consulting services to companies and governments facing restrictions in accessing the Brazilian or foreign market;
- Analysis and advice on tariff and non-tariff barriers such as: technical measures, sanitary and phytosanitary measures, rules of origin and quantitative restrictions;
- Consulting on the impact of the REACH system and other similar regulations.
In this field, the team has already worked on behalf of companies that manufacture child car seats and toys due to technical measures, as well as on behalf of chemical products exported to the European Union under the REACH system and to the United States under the tariff preference program (Generalized System of Preferences – GSP).
International Trade Law
- Analysis and consulting on issues related to International Trade Law, as well as bilateral, regional, and multilateral negotiations involving Brazil;
- Compliance analysis of measures/agreements with Mercosur and World Trade Organization (WTO) rules;
- Drafting and reviewing agreement minutes in the context of international negotiations;
- Analysis of the impact of specific international negotiations and agreements on the private sector.
Examples of the team’s involvement in this area include advising companies and governments on compliance with WTO rules, drafting agreements in the tobacco and cigarette sector, and analyzing the impact of renegotiating international agreements for the automotive sector.
