{"id":1028,"date":"2024-10-01T19:46:31","date_gmt":"2024-10-01T22:46:31","guid":{"rendered":"https:\/\/devivocastro.com.br\/?p=1028"},"modified":"2026-02-03T16:48:39","modified_gmt":"2026-02-03T19:48:39","slug":"infracoes-ambientais","status":"publish","type":"post","link":"https:\/\/devivo.letsite.com.br\/en\/infracoes-ambientais\/","title":{"rendered":"Federal Decree No. 12,189\/2024: New Measures and Sanctions for Environmental Infractions"},"content":{"rendered":"<p><strong><span dir=\"auto\">Federal Decree No. 12,189\/2024: New Measures and Sanctions for Environmental Infractions<\/span><\/strong><\/p>\n<p><span dir=\"auto\">The new Federal Decree No. 12,189\/2024 amended Federal Decree No. 6,514\/2008, which regulates administrative infractions and sanctions related to the environment in Brazil.<\/span><\/p>\n<p><strong><span dir=\"auto\">New Article 16-A: Increased Control of Environmental Infractions<\/span><\/strong><\/p>\n<p><span dir=\"auto\">One of the modifications was the inclusion of a new type of environmental embargo, focused on controlling degraded areas.<\/span><\/p>\n<p><span dir=\"auto\">This measure allows the competent authority to embargo a set of polygons corresponding to related environmental infractions, with the objective of:<\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span dir=\"auto\">Stop the violation and environmental degradation.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span dir=\"auto\">To prevent anyone from profiting or gaining an economic advantage from the infraction.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span dir=\"auto\">To prevent further violations.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span dir=\"auto\">To safeguard the environmental recovery of the area.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span dir=\"auto\">To promote the repair of environmental damage caused.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span dir=\"auto\">To ensure the effectiveness of administrative accountability processes.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span dir=\"auto\">These changes aim for more efficient monitoring and preventive blocking of areas affected by infractions, including large areas within specific biomes or conservation units.<\/span><\/p>\n<p><strong><span dir=\"auto\">New Penalty Values<\/span><\/strong><\/p>\n<p><span dir=\"auto\">\u200b\u200bIn addition to the operational changes, an adjustment was also made to the values \u200b\u200bof fines applicable to different environmental infractions.
